Terms of Service

Welcome to Featherweight. These Terms of Service ("Terms") govern your use of the Featherweight mobile application ("App") and related services. By creating an account and using Featherweight, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Featherweight, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable local, state, national, and international laws
• Be at least 16 years of age (or the age of majority in your jurisdiction, whichever is higher)

If you do not agree to these Terms, you must not use the App.

2. Description of Service

Featherweight is a weightlifting tracking application that provides:

• Workout logging and tracking (exercises, sets, reps, weights, rest times)
• Programme management and structured training plans
• One-rep max (1RM) calculation and personal record tracking
• Exercise library with 300+ system exercises and custom exercise creation
• Training insights and progress analytics
• Cloud synchronization across devices via Firebase
• AI-powered training analysis and programme recommendations (optional)
• Voice input for hands-free workout logging (optional)

3. User Accounts

3.1 Account Creation

• You must provide a valid email address and create a secure password
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Security

• You must not share your account credentials with others
• You must use a strong, unique password
• We recommend enabling email verification for added security
• You are solely responsible for any loss or damage arising from your failure to protect your account

3.3 Account Termination

You may delete your account at any time through the Settings tab. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Acceptable Use

4.1 Permitted Uses

You may use Featherweight for:

• Personal, non-commercial fitness tracking and workout logging
• Creating and managing your own training programmes
• Tracking your personal records and progress
• Analyzing your training data and performance

4.2 Prohibited Uses

You must not:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including but not limited to copyright laws)
• Attempt to gain unauthorized access to the App, servers, or databases
• Reverse engineer, decompile, or disassemble the App
• Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices
• Use automated systems (bots, scrapers, etc.) to access the App without permission
• Transmit viruses, malware, or any malicious code
• Interfere with or disrupt the App's servers or networks
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest personal information of other users
• Use the App to provide professional training or coaching services without proper licensing

5. Intellectual Property Rights

5.1 Ownership

Featherweight and all related content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, and the exercise database) are owned by Featherweight and protected by international copyright, trademark, and other intellectual property laws.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Featherweight for personal, non-commercial purposes in accordance with these Terms.

5.3 Your Data

You retain ownership of all workout data, custom exercises, and other content you create in the App. By using cloud sync, you grant us a license to store and process your data solely for the purpose of providing the service.

5.4 Open Source Software

Featherweight is built using open-source libraries and components. You can view the full list of third-party dependencies and their licenses in the App's About section.

6. Disclaimer of Warranties

FEATHERWEIGHT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content or data
• Warranties regarding the results you may obtain from using the App

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATHERWEIGHT, ITS DEVELOPERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Personal Injury or Property Damage: Any injuries, death, or property damage resulting from your use of the App or participation in exercise activities
• Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
• Lost Data: Loss of data, profits, revenues, or business opportunities
• Service Interruptions: Interruptions, errors, bugs, or security breaches
• Third-Party Services: Actions or omissions of third-party services (Firebase, AI providers, etc.)
• AI Recommendations: Any harm resulting from following AI-generated training recommendations

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE PAST 12 MONTHS (CURRENTLY $0, AS THE APP IS FREE).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Featherweight, its developers, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any injury or damage you sustain while using the App or exercising
• Any content or data you submit to the App

9. Data and Privacy

Your use of Featherweight is also governed by our Privacy Policy. Key points include:

• All local data is encrypted using Android's Filesystem-Based Encryption
• Cloud sync uses Firebase with encryption in transit and at rest
• AI features send workout data to AI services (only when you use them)
• You can export your data at any time
• You can delete your account and all associated data

10. Third-Party Services

10.1 Firebase (Google Cloud Platform)

Cloud sync and authentication are provided by Firebase. You agree to comply with Firebase's Terms of Service.

10.2 AI Services

AI features use third-party AI providers. By using AI features, you acknowledge that your workout data will be processed by these services in accordance with their usage policies.

10.3 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites.

11. Service Modifications and Termination

11.1 Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature or functionality at any time
• Change pricing or introduce fees (with advance notice)
• Update the App with new versions or remove support for old versions

11.2 Service Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the service entirely

11.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• You should export your data before termination if you wish to retain it
• Data retention is governed by our Privacy Policy

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at featherweight.app@gmail.com to attempt informal resolution.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom, without regard to conflict of law provisions.

12.3 Arbitration

Any disputes arising from these Terms or your use of Featherweight may be resolved through binding arbitration in accordance with the laws of England and Wales, except where prohibited by law. This arbitration clause does not apply to users in jurisdictions where such clauses are not enforceable. You waive your right to participate in class action lawsuits, except where such waivers are prohibited by applicable law.

12.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the App.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top
• Displaying an in-app notification
• Sending an email to your registered email address (for significant changes)

Your continued use of Featherweight after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the App and delete your account.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Featherweight regarding your use of the App and supersede all prior agreements.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Assignment

You may not assign or transfer these Terms or your account to any third party without our written consent. We may assign our rights and obligations under these Terms without restriction.

18. Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about Featherweight, you grant us a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback into the App without compensation or attribution.
